General Terms and Conditions for Online Tickets

1. The online ordering of tickets is processed via the external provider “Starjack.” The Terms and Conditions of Starjack can be found here: starjack.com/gtc. Bergbahnen Kühtai are the service providers and the “operator” of the shop, while “Starjack” acts as the “processor.”

2. Only persons of legal age are entitled to purchase online tickets and online vouchers.

3. The purchase of online tickets is only possible after complete and correct entry of all mandatory fields in the booking window. The visitor is solely responsible for the correct entry of their data.

4. The order process for online tickets is completed by clicking the button “Order with obligation to pay” (or similar wording). By doing so, the visitor submits a binding offer to purchase an online ticket.

5. For online lift tickets, acceptance occurs through the transmission of a confirmation email. Bergbahnen Kühtai assume no liability for loss or negligent storage of the QR code, nor for unauthorized third-party access. Invalid or canceled booking codes do not entitle the holder to collect lift tickets.

6. The booked service can be used immediately after receipt of the confirmation email. The confirmation email serves as proof of a properly completed booking and must therefore be carried by the visitor and presented to Bergbahnen Kühtai in case of complaints or problems. 7. Online lift tickets can be purchased for 1–14 days. Multi-ride passes, morning passes, as well as lift tickets for the categories disabled persons and groups cannot be purchased online. When purchasing online tickets, an exact validity period must be selected, which cannot be changed afterwards.

8. Payment for online tickets is possible only using the payment methods indicated during the ordering process. If a payment chargeback occurs before collecting the lift ticket, the QR code becomes invalid. Bergbahnen Kühtai rely on partners, such as Starjack, for technical and financial processing of online bookings.

9. Unless otherwise stated during the booking process, the company does not enter into a separate (direct) contractual relationship with the visitor. During the booking process, redirection to third-party websites may occur, for which the respective company is solely responsible.

10. The indicated prices for online lift tickets include VAT.

11. The stated “Online from” price is the lowest available online rate. Ski passes are cheapest at the start of the sales period in the online shop, up to 30 days before the first day of use.

12. Cancellation of ski passes is only possible with the “Money-Back Guarantee” upgrade, which is offered in the ticket shop at the time of purchase. The upgrade costs €3.00 per ski pass and per day. With this upgrade, ski passes can be refunded up to 3 days before the first day of validity without giving reasons. Please send your cancellation request by email to tickets@lifte.at and provide your order number. The upgrade can only be applied to the entire order. After selecting tickets in the shopping cart, the “Money-Back Guarantee” can optionally be added for all ski passes.

13. The contractual partner is obliged to provide complete and correct information when concluding the contract. In the case of incorrect, incomplete, or unclear information, the contractual partner shall be liable for all costs and damages incurred by Bergbahnen.

14. Right of withdrawal for consumers (not valid for businesses) / ONLINE SHOP
Since the booked services relate to leisure activities and a specific time or period is contractually agreed for fulfillment by Bergbahnen, the user has no right of withdrawal.

15. Choice of law and jurisdiction
All contracts concluded between Bergbahnen and its contractual partner and all claims arising from the legal validity or invalidity of these contracts are subject to Austrian substantive law, excluding the provisions of Austrian international private law. The exclusive place of jurisdiction for all legal disputes arising from contracts concluded on the basis of these terms and conditions shall be the competent court for A-6183 Kühtai. However, Bergbahnen may also sue the contractual partner at another domestic or foreign court of jurisdiction.

16. Data protection and data processing
We take the protection of your personal data very seriously. The personal data provided to us is processed in accordance with the provisions of the EU General Data Protection Regulation (GDPR) and the new Data Protection Amendment Act. Bergbahnen Kühtai have implemented appropriate technical and organizational measures in cooperation with data processors to ensure that no unauthorized access occurs. Processing of personal data is carried out exclusively on the basis of a legal justification as defined in Art. 6 (1) GDPR, primarily for the purpose of providing the contractually agreed services and fulfilling various legal obligations.

17. The online presentation of our company’s offers and services takes place within the online presence of www.lifte.at.

18. Where personal data is provided, it will be used for processing inquiries and/or bookings, providing other services, as well as for administrative purposes.

19. The contractual partner agrees that their personal data may be stored and, where necessary, processed. The personal data of the contractual partner will be treated strictly confidentially in accordance with data protection law.

20. Personal data will neither be sold nor otherwise marketed. Personal data will only be transferred or disclosed to third parties if this is necessary for business transactions or if prior consent has been given. Consent may be withdrawn at any time. It may also be necessary to disclose personal data due to legal requirements or legal proceedings.

21. Transport is only permitted after access control. The location and number of entries are stored exclusively for billing purposes and, where necessary, for contract fulfillment.

22. For the purpose of access control, a reference photo of the lift ticket holder is taken when first passing through a turnstile equipped with a camera. This reference photo is compared by lift personnel with photos taken at each subsequent passage through such a turnstile. This data application (Photo Compare) has been registered with the Data Protection Authority and is listed in the Data Processing Register.

23. The reference photo is deleted immediately after the validity of the lift ticket expires; other photos are deleted at the latest 30 minutes after the respective passage through a turnstile. Please note that it is also possible to purchase lift tickets that are technically configured so that no photo is taken when passing through the turnstile. In this case, however, random checks by lift personnel must be expected.

24. At the express request of the customer, Bergbahnen Kühtai lift tickets without the photo compare function can be purchased at the lift ticket office. Information on prices for this non-standard ski pass ticket is available at the lift ticket office.
